Distance Sales Agreement

1. Parties

BUYER: the person who fills in the reservation form and confirms the reservation. The BUYER's first and last name, email address and phone number are those given in the reservation form.

2. Definitions

• Prepayment: for reservations where the SELLER offers online payment, the amount collected online at the time of reservation and deducted from the total rental price.
• Deposit: the security amount taken when the vehicle is handed over and returned when the vehicle is brought back in the agreed condition. The deposit is not part of the rental price.
• Rental day: a period of 24 hours starting from the time the vehicle is handed over.

3. Subject of the Agreement

The subject of this agreement is the rental by the SELLER to the BUYER of the motorcycle or scooter model the BUYER selects on the site, for the dates and times stated in the reservation, and the rights and obligations of the parties in relation to that rental.

This agreement applies together with the Preliminary Information Form, the Rental Terms and Fees and the Delivery, Cancellation and Refund Terms published on the site. The rental agreement and handover records drawn up when the vehicle is handed over supplement this agreement.

4. Main Features of the Service and Price

The rented model, the pickup and return date, time and branch, the number of rental days and the total rental price are shown in the reservation summary before the reservation is confirmed.

The total rental price is calculated by multiplying the daily rental price of the selected model by the number of rental days. If handover or return at an airport is selected, a delivery fee of 60 euros one-way also applies; for delivery to a custom address the fee depends on the distance and is communicated to the BUYER before the reservation. Prices include applicable taxes.

The price is shown in Turkish lira on the Turkish version of the site and in euros on the other language versions, and online payment is collected in the same currency.

Compulsory third-party liability (traffic) insurance is included in the rental price. Comprehensive insurance is optional and subject to an additional daily fee.

The daily distance limit is 150 km for 50-500 cc vehicles, 200 km for 600-900 cc vehicles and 250 km for vehicles of 1000 cc and above. Other charges that may arise depending on use (late fee, bridge and motorway tolls, loss and damage fees) are shown on the Rental Terms and Fees page.

5. Payment

For reservations where the SELLER offers online payment, the BUYER pays a prepayment of 20 percent of the total rental price at the time of reservation or, if the BUYER prefers, the full amount. The prepayment is deducted from the total rental price; the balance is paid when the vehicle is handed over. For these reservations, confirming the reservation creates an obligation to pay.

For reservations where no online payment is taken, the reservation request is free of charge and the full rental price is paid when the vehicle is handed over.

Online payments are collected on the payment page of the payment institution iyzico by debit or credit card with 3D Secure verification. Card details are not seen or stored by the SELLER.

When the vehicle is handed over, a deposit determined by vehicle class is taken separately: 150 euros for scooters, 300 euros for manual motorcycles, 500 euros for adventure motorcycles and 700 euros for large-displacement motorcycles. The full deposit is returned when the vehicle is brought back in the agreed condition.

6. Formation of the Contract, Handover and Performance

For reservations with an online prepayment, the contract is formed when the payment is completed. For reservation requests without a prepayment, the contract is formed when the SELLER confirms the request and notifies the BUYER.

The vehicle is handed over to the BUYER at the pickup branch selected in the reservation or at the agreed delivery address, on the stated date and time.

To collect the vehicle, the BUYER must bring the original of a valid driving licence appropriate to the vehicle class, the original of an ID card or passport, and a debit or credit card for the deposit. The minimum rental age is 21; for large-displacement motorcycles the BUYER must be at least 25 and hold a full A licence. The vehicle is not handed over to a person who does not meet these conditions.

If the SELLER is unable to hand over the reserved vehicle, the SELLER notifies the BUYER within three days of becoming aware of this and refunds the full amount collected online within 14 days of the notification at the latest.

7. Right of Withdrawal

Under Article 15(1)(g) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for vehicle rental contracts to be performed on a specific date or within a specific period. The BUYER therefore has no right of withdrawal under this agreement.

The SELLER nevertheless grants the BUYER a contractual right to cancel; its conditions are set out in Article 8 and on the Delivery, Cancellation and Refund Terms page.

8. Cancellation, Changes and Refunds

For cancellations made at least 48 hours before the pickup time, if an online prepayment was taken, the full prepayment is refunded.

For cancellations made less than 48 hours before the pickup time, and if the vehicle is not collected, the online prepayment is not refunded.

Requests to change the dates or model are carried out free of charge, subject to availability, at least 48 hours before the pickup time.

Refunds are made through iyzico to the card used for payment; depending on the bank, it may take 3 to 14 working days for the amount to appear on the account.

9. Obligations of the BUYER

The BUYER uses the vehicle in line with the rules on the Rental Terms and Fees page. Only the BUYER may ride the vehicle. During the rental period the BUYER is responsible for the vehicle and the equipment handed over.

Bridge and motorway tolls for the rental period and traffic fines arising from the BUYER's use of the vehicle are borne by the BUYER.

10. Personal Data

The BUYER's personal data is processed as explained in the Privacy Notice (KVKK) and Privacy Policy. Sending commercial electronic messages depends on a separate approval given by the BUYER and is not a condition of this agreement.

11. Complaints and Dispute Resolution

The BUYER may send complaints and requests to the SELLER's contact details in Article 1.

In disputes arising from this agreement the BUYER may apply, for claims below the monetary limit set each year by the Ministry of Trade, to the Provincial or District Consumer Arbitration Committee at the BUYER's place of residence or where the transaction took place, and for claims above that limit to the Consumer Court. Applying to a mediator is mandatory before filing a case with the Consumer Court (Law No. 6502 Art. 73/A).

12. Entry into Force

By ticking the approval box in the reservation form and confirming the reservation, the BUYER declares having read the Preliminary Information Form and accepts this agreement electronically.

The BUYER can access the current text of this agreement on the site at any time; on request the SELLER sends the text accepted by the BUYER by email. The Turkish text of the agreement prevails.
